These Terms of Service ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME], a California [LLC / corporation], doing business as CaliGlassCo ("CaliGlassCo," "we," "us," "our"), governing your access to and use of caliglassco.com and any purchase you make from us (the "Services").

By browsing the site or placing an order, you accept these Terms. Our Shipping Policy, Return & Refund Policy, and Privacy Policy are incorporated by reference and form part of these Terms.

You must be at least 21 years of age to access this site or purchase any product from CaliGlassCo. By using the Services you represent and warrant that:

• You are 21 years of age or older;
• You are purchasing for yourself, and not for or on behalf of any person under 21;
• You will not resell, transfer, or provide any product to a person under 21;
• The product is lawful for you to purchase, receive, possess, and use at your address;
• You will provide valid government-issued identification on request and at delivery.

Providing false age or identity information is a material breach of these Terms. It voids the transaction, forfeits any right to a refund, and may expose you to liability under state and federal law. We may refuse or cancel any order and refund it in full at our sole discretion.

All products sold by CaliGlassCo are intended and sold for use with legal tobacco and other lawful products only.

We do not sell cigarettes, smokeless tobacco, roll-your-own tobacco, electronic vaporizers, e-nails, vape devices, e-liquid, or any electronic inhalation device. Our catalog consists of non-electronic glass, accessories, and lifestyle goods.

By purchasing, you represent that you will use the product only in a manner lawful in your jurisdiction. You agree not to:

• Use, or state an intent to use, any product with a controlled substance in violation of applicable law;
• Reference illegal drugs or drug slang in order notes, product reviews, emails, messages, or any communication with us.

We reserve the absolute right to refuse or cancel any order, and to terminate any account, where a customer states or implies an unlawful intended use. This is not a formality — we enforce it.

No product description, image, blog post, or communication from us should be read as encouragement, instruction, or approval of any unlawful activity, and none of it is legal advice.

Laws governing the sale, shipment, possession, and use of the products we sell vary substantially by state, county, and city and change frequently. Some jurisdictions restrict or prohibit these products entirely; some impose local licensing requirements.

You alone are responsible for knowing and complying with every federal, state, and local law that applies to your purchase, possession, transport, and use of any product you buy from us. The availability of an item at checkout is not a representation that it is lawful where you live.

If a shipment is refused, seized, or destroyed by a carrier, regulator, or law enforcement because the item is unlawful at your destination, you are not entitled to a refund.

You agree to indemnify us in full for any claim, penalty, or cost arising from your violation of any law relating to a product purchased from us.

You acknowledge and agree that:

• Glass is fragile and breaks. Broken glass causes lacerations. You assume all risk of injury from handling, cleaning, dropping, or breaking any glass product.
• Heated components reach extreme temperatures. Quartz, titanium, and ceramic components and torch flames cause severe burns and can ignite surroundings. A banger stays dangerously hot long after it stops glowing. Never leave a heat source unattended.
• Butane and other fuels are flammable and explosive. Use only per the manufacturer's instructions, in a ventilated area, away from heat and ignition sources.
• Thermal shock cracks glass. Do not apply water to hot glass or heat cold glass.
• You will follow all manufacturer instructions and warnings, keep products out of reach of children and pets, and store fuel safely.
• We are not liable for injury, property damage, fire, or loss arising from the use, misuse, modification, or improper storage of any product, or from any product altered after delivery.

No health, medical, or safety claims. We make no representation that any product is safe for health or reduces any risk of any kind. Inhaling combusted or vaporized material carries health risks. Consult a physician with questions about your health.

Much of our inventory is hand-blown, artist-made glass. Color shifting, small bubbles, variation in work lines, slight asymmetry, and differences in size, weight, and finish from the listing photograph are inherent characteristics of handmade glass and are not defects. Joint sizes and fitment are listed to the best of our knowledge; confirm compatibility before ordering.

Artist and one-of-a-kind pieces are unique and cannot be replaced. We will provide additional photographs, video, measurements, or joint specifications on request before purchase — please ask.

We make reasonable efforts to describe and picture products accurately, but do not warrant that descriptions, specifications, dimensions, artist attributions, images, or pricing are error-free, complete, current, or reliable. Colors render differently on different displays.

We reserve the right to correct errors and to refuse or cancel any order placed at an incorrect price, even after order confirmation and payment authorization. If we cancel for a pricing error, we notify you and refund in full. Availability, pricing, and promotions may change without notice, and we may limit quantities per customer or per order.

Your order is an offer to purchase, not a binding contract. Our confirmation email acknowledges receipt only. A contract forms when we ship the item or release it for pickup. We may accept, decline, limit, or cancel any order in whole or in part, including for:

• Failed age or identity verification
• Suspected fraud or unauthorized payment method use
• Pricing, listing, or inventory errors
• Shipping destinations where the product is restricted
• Stated or implied unlawful intended use
• Suspected unauthorized resale
• Prior return abuse or chargeback activity

You represent that you are authorized to use any payment method you submit and that your billing information is accurate. You authorize us to charge the total order amount including shipping and tax.

All prices are in U.S. dollars. Sales tax is calculated at checkout based on your shipping address. Certain products may be subject to additional state or local excise taxes, which are included in the price or shown at checkout.

If a payment is reversed, declined, or charged back, you remain liable for the amount owed plus any fees we incur, and we may suspend your account.

You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of unauthorized use. We may suspend or terminate accounts that violate these Terms. Do not share your account with anyone under 21.

You may not:

• Use the Services for any unlawful purpose, or to solicit unlawful acts
• Misrepresent your age or identity, or circumvent our age gate or verification
• Purchase on behalf of a person under 21, or for unlawful resale or transfer
• Reference illegal drug use in any submission to us
• Infringe our or any third party's intellectual property, including artist designs and photographs
• Harass, abuse, defame, or threaten our staff, our artists, or other customers
• Introduce viruses or malicious code, or interfere with the site's security or operation
• Scrape, spider, data-mine, or harvest content, pricing, or images by automated means
• Circumvent shipping restrictions or purchase limits

Violation may result in immediate termination of access.

The site and its content — text, graphics, logos, layout, photography, video, and code — are owned by us or our licensors and protected by U.S. and international intellectual property law. You may not reproduce, distribute, modify, or create derivative works without our prior written permission. Our product photography is original work and is not licensed for reuse, including resale listings.

Artist and brand marks. Artist names, signatures, and brand names and logos, including Empire Glassworks, Elbo Supply Co., VIP Glass, and the individual artists whose work we carry, are the property of their respective owners and are used solely to identify the products we offer. CaliGlassCo is a retailer and gallery, not the maker, and is not affiliated with, endorsed by, or sponsored by those artists or brands except as expressly stated.

If you submit reviews, photos, comments, or other content, you grant us a non-exclusive, royalty-free, perpetual, worldwide, transferable, sublicensable license to use, reproduce, modify, publish, and display it in any medium, including marketing, without compensation or attribution.

You represent that your content is your own, accurate, non-infringing, and not unlawful, obscene, defamatory, or abusive, and that it does not depict or reference the use of any controlled substance. We may edit, refuse, or remove any submission at our discretion, but have no obligation to monitor content.

The site may link to third-party sites or integrate third-party services (payment processors, carriers, review platforms, chat tools, age-verification vendors). We are not responsible for their content, products, policies, or practices. Your dealings with them are solely between you and them.

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

Manufacturer warranties. Some products may carry a limited warranty from the manufacturer, administered by the manufacturer alone. Handmade glass carries no warranty against breakage. Nothing in this section limits any manufacturer warranty or any non-waivable right you have under applicable consumer law, including the California Song-Beverly Consumer Warranty Act.

TO THE FULLEST EXTENT PERMITTED BY LAW, CALIGLASSCO AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including lost profits, lost data, personal injury, property damage, fire, or business interruption, arising from or relating to your use of the Services or any product purchased, whether in contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of the above may not apply to you. Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by our gross negligence or willful misconduct.

Informal resolution first. Before filing any claim, contact us at support@caliglassco.com and give us 60 days to resolve the issue informally. Nearly every dispute ends here.

Binding arbitration. If we cannot resolve it informally, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will be held in Contra Costa County, California, or by videoconference or on documents at your election. The award may be entered as a judgment in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

Your right to opt out. You may reject this arbitration agreement by emailing support@caliglassco.com with subject line Arbitration Opt-Out within 30 days of your first purchase, including your name, address, and order number. Opting out does not affect any other part of these Terms.

Jury trial waiver. If a claim proceeds in court rather than arbitration, you and we each waive any right to a jury trial, to the extent permitted by law.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to Section 16, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Contra Costa County, California.

You agree to indemnify, defend, and hold harmless CaliGlassCo and its owners, officers, employees, agents, and suppliers from any claim, demand, loss, liability, damage, penalty, or expense (including reasonable attorneys' fees) arising from or relating to: (a) your breach of these Terms; (b) any misrepresentation of your age, identity, or intended use; (c) your violation of any law or the rights of a third party; (d) your possession, use, misuse, modification, transport, storage, or resale of any product purchased from us; and (e) any injury, fire, or damage you or a third party suffers in connection with a product purchased from us.

These Terms remain in effect until terminated. You may terminate by ceasing use and closing your account. We may terminate or suspend your access at any time, without notice, for any reason, including breach. Obligations incurred before termination — including payment obligations and Sections 3, 4, 5, 14, 15, 16, and 18 — survive termination.

• Severability. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remainder stays in force.
• No waiver. Our failure to enforce a right or provision is not a waiver of it.
• Assignment. You may not assign these Terms. We may assign them in a merger, acquisition, or sale of assets.
• Force majeure. We are not liable for delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disaster, epidemic, war, civil unrest, labor action, carrier failure or carrier policy change, supply-chain disruption, utility or internet outage, or governmental or regulatory action.
• Entire agreement. These Terms and the incorporated policies are the entire agreement and supersede prior agreements or communications.
• Headings. For convenience only; no legal effect.
• Notices. We may give notice by email to your account address or by posting to the site. Send notices to support@caliglassco.com.

By providing your email address or phone number you consent to receive communications from us electronically and agree that electronic agreements, notices, and disclosures satisfy any legal requirement that they be in writing.

SMS: If you opt into text messages, you consent to recurring automated marketing texts at the number provided. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to cancel, HELP for help.

Suggestions, ideas, and feedback you send us are non-confidential and we may use them for any purpose without compensation or obligation.

If you believe content on our site infringes your copyright — including artists and photographers — send a DMCA notice to support@caliglassco.com including: identification of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief, a statement under penalty of perjury that the information is accurate and you are authorized to act, and your physical or electronic signature. We respond promptly to valid notices.

We work toward conformance with WCAG 2.1 Level AA. If you encounter a barrier, email support@caliglassco.com and we will assist you and work to fix it.

We may revise these Terms at any time by posting an updated version with a new "Last updated" date. Changes are effective when posted. Continued use constitutes acceptance. The version in effect when you place an order governs that order.
